I bought an iPod Touch 4th Gen on Amazon, and it's defective.

Hello there. I just recieved an Apple iPod Touch 4th Generation 16g that I purchased on Amazon on the 9th, and as it turns out, it does not recognize any pair of headphones put in the jack, (I have tried all solutions) as well as the down volume button does not work. The seller sent me this e-mail when I inquired: :I am very sorry to hear that you are having problems with the item. I see that the ipod still has apple warranty. I can offer you 2 options. You can take it to your local apple store or send it on the mail and they will exchange it for a new one if it can't be fixed."

 

 

 

So, the seller listed it as still under Warranty, but after contacting Apple and apparently a bunch of monkies, it seems my 90 days tech support expired or whatever. My question is, will I have to pay to have this crap fixed or replaced? Can I bring it in to the nearest Apple store and guarantee it will happen that day? I'm so frustrated right now.
